Beware: Property you CANNOT include in a Trust
While putting together your estate plan, you should make a list of all property that you wish to transfer into a will or trust. However, you should have an attorney review any documents or assets which appear complicated because not all property is transferable, even though you may believe you have the right to transfer certain property. For more information about estate planning in California, you should consult with an experienced Los Angeles estate planning lawyer
Certain property cannot be included in a trust. The following list will give you an idea as to categories of property which should not be included in a trust, but the list is not exclusive: executory contracts for personal services, for example an employment contract to work as a hair stylist, interest of a beneficiary under a spendthrift trust, property that has not come into existence, property that no longer exists, to transfer the property would be against public policy, tort claims and the interest of a joint tenant in joint tenant property.
