Postprobate Contests and Timely Filing of Demurrer to Contests Part I

In Moss v. Moss (2012), the Fourth District Court of Appeal held that an attorney has an implied authority to represent their client including service of process as provided under the Code of Civil Procedure section 416.90. The Court of Appeal further held that if a preprobate contest has not been adjudicated, then Probate Code section 8270 does not bar a postprobate contest.
