What Is a California Heggstad Petition AKA Probate Code 850?

Under Probate Code §850(a)(3), any interested person, typically a trustee, can file a petition if the trustee is in possession of real or personal property that is claimed to another. The trustee will also be required to have a claim to real or personal property, title to or possession of what is held by another. The last requirement is that the property of the trust will have to be claimed to be in subjection to a creditor of the settlor of that particular trust.
