What Is Heirship?
Heirship is the legal right to inherit property. This right is based on the law of intestacy, which dictates that a person's property will be distributed to their heirs if they do not leave a will specifying how they would like their property to be distributed. For example, if a person dies without a will, their property will be distributed to their spouse, children, and other relatives according to the laws of intestacy.
In some cases, a person may be entitled to part of an estate but not all of it. For example, if a person is named as an heir to a parent's estate, but the parent has three other children, the heir may be entitled to a portion of the estate but not all of it. In these cases, an heir may petition the court to establish heirship. This petition must be filed within a certain period of time after the person's death, usually between nine and 12 months.
